Presence — Meditation Timer
1. Acceptance of Terms
By downloading, installing, or using Presence — Meditation Timer ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of the App, including users of the free tier and Presence Pro subscribers.
2. Description of the App
Presence is a meditation timer app for iOS that provides:
- Configurable meditation timers with chime and ambient sounds
- Mindful session logging to Apple Health
- A growth tracking system that visualizes your meditation progress
- Push notification reminders
- Customizable themes and color palettes
- Presence Pro: a one-time in-app purchase unlocking additional chimes, color palettes, and growth stages
3. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App.
4. In-App Purchases
4.1 Presence Pro
The App offers a one-time, non-consumable in-app purchase called Presence Pro that unlocks additional premium features. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions.
4.2 No Refunds
All sales are final. We do not offer refunds for in-app purchases. If you believe you have been charged in error, you may request a refund directly from Apple through the App Store.
4.3 Restore Purchases
If you reinstall the App or switch devices, you can restore your Presence Pro purchase at no additional charge using the "Restore Purchases" option within the App.
4.4 Price Changes
We reserve the right to change the price of Presence Pro at any time. Price changes will not affect purchases already made.
5. Apple Health Integration
5.1 Optional Feature
Integration with Apple Health (HealthKit) is entirely optional. You may use the App without granting Health access.
5.2 Data Written to Health
If you grant permission, the App will write Mindful Session data to Apple Health, recording the start time, end time, and duration of completed meditation sessions. The App does not read any data from Apple Health.
5.3 Your Control
You can revoke HealthKit access at any time through iOS Settings > Privacy & Security > Health. Revoking access will prevent future sessions from being logged but will not delete previously saved data from Apple Health.
6. Notifications
The App may request permission to send local push notifications for meditation reminders. Notifications are optional and can be disabled at any time through iOS Settings > Notifications > Presence.
7. Privacy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we handle your information. Key points:
- The App does not collect, store, or transmit personal data to external servers.
- All meditation data, growth progress, and settings are stored locally on your device or in Apple Health.
- Presence Pro purchase status is stored securely in your device's Keychain.
By using the App, you agree to our Privacy Policy.
8. Intellectual Property
All content within the App — including but not limited to graphics, sounds, interface designs, growth stage artwork, and software code — is owned by or licensed to the developer and is protected by copyright and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content in the App without express written permission.
9. Prohibited Conduct
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Attempt to bypass, disable, or circumvent any feature gating or licensing mechanism
- Use the App for any unlawful purpose or in violation of any applicable law
- Interfere with or disrupt the integrity of the App
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Presence is not a medical app. It is not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional for medical advice.
11. Limitation of Liability
To the fullest extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for Presence Pro.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this document. Continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.
